Retail Supplier Answers Show Cause Order
Light Power & Gas, LLC has responded to a show cause order issued against the ESCO by the New York PSC in which the PSC had alleged that the company failed to file an annual compliance update to its license, and allegedly failed to file with the Secretary information on the entities marketing on its behalf.
Light Power & Gas has now submitted the requisite filings, and said that, "its previous failure to submit the filings was solely due to an inadvertent oversight directly stemming from LPG's relatively dormant business activities."
Light Power & Gas received its ESCO certification in the spring of 2013, but, "due to a confluence and financial and market factors, LPG placed its operations in abeyance and essentially suspended its business activities. The relatively suspended status remains in effect as of this date."
"In view of the inert operating and business condition of LPG, its officers did not monitor its status on an active basis as little business was being conducted. Unfortunately, this led to an inadequate monitoring of mailings and communications that were sent to LPG, including the various notices from DPS. As a result, LPG did not become aware of the notices from DPS in a timely manner, and therefore failed to respond adequately to DPS Staff. The gap in monitoring of communications had been rectified and all communications related to LPG including any letters or notifications from DPS will be reviewed on a timely basis to ensure that the prior oversight does not reoccur," the company said.
"LPG respectfully submits that it has demonstrated that it would be unreasonable to revoke LPG's eligibility to act as an ESCO in New York State or impose any other consequences as set forth in the UBP," the company said.
