Texas PUC Directs City of McAllen To Respond to REP's Complaint That City Usurped PUC's Jurisdiction In Ordering Refund To Customer

The Public Utility Commission of Texas has directed the City of McAllen to file a response to the petition from AP Gas and Electric, in which APG&E sought a declaratory order from the PUC stating that the Mayor of the City of McAllen, acting on the City's behalf, exceeded the City's jurisdiction when hearing and ruling on the complaint case brought to it by LFD, LLC d/b/a LFD Homefurnishings (LFD) against APG&E.

As first reported by EnergyChoiceMatters.com, the City of McAllen, Texas asserted jurisdiction in a complaint case brought to the City by the customer, and ordered AP Gas and Electric to refund a $250,000 early termination fee to the customer.

The PUC directed that on or before March 30, 2016, the City of McAllen shall file a response to the petition.

On or before April 6 2016, PUC Staff was directed to file response and recommendation regarding notice and a procedural schedule for processing the proceeding, if appropriate.
