NY PSC Staff Seek To Double Under-Delivery Penalties For ESCOs

Staff of the New York PSC have recommended doubling certain under-delivery penalties for ESCOs at KeySpan New York and KeySpan Long Island (National Grid), in testimony on the KeySpan LDCs' current rate case

"We are concerned with the value of the charges for deliveries that fall below the daily delivery quantity the Companies instructed the transporters to deliver," Staff said.

"Transporters are required to deliver a minimum 98% of the daily forecast provided by the Company. Failure to do so, especially for larger volume customers, can place an unnecessary burden on the distribution system and utilization of upstream assets. Deliveries falling below this level are subject to a market based commodity rate plus a penalty charge of $10 per Dth for non-operational flow order (OFO) and $25 per Dth during OFO events," Staff said

"To provide a sufficient incentive for the protection of system integrity, we recommend the penalty for under delivery during non-OFO events be increased to $25 per Dth and for OFO events be increased to $50 per Dth. This change should be applicable to all monthly balanced customers, firm and non-firm alike," Staff said

"We also recommend that these charges be properly identified in tariffs as 'penalty' charges. In addition, daily balancing tier levels applied to daily balanced customers should also be clearly identified as to what is a penalty and what is a gas cost. With daily balancing, the Daily Gas Purchase Price is the actual gas cost. Surcharges to the price applied for sale of gas to a customer by a company due to an under-delivery and discounts applied to the price credited to a customer for sale of gas to a company due to an over-delivery should clearly be identified as penalties in the tariffs and GTOP manual," Staff said
