Texas Retail Provider Objects To Start-up's Sought Trade Name
StarTex Power has protested the application of start-up retail supplier Windrose Power & Gas, LLC to include the trade name "Tex-Power" on Windrose's Texas retail electric provider certificate
Windrose's Texas application and its sought use of the trade name "Tex-Power" had been first reported by EnergyChoiceMatters.com (click here for background on the start-up)
"The d/b/a name "Tex-Power" sought by Applicant is substantially similar to StarTex Power and would be likely to mislead and confuse customers and would be duplicative in the marketplace. Furthermore, StarTex Power is a registered name and mark in Texas under Registration No. 800460442. Both the Applicant and Intervenor are located in the greater Houston area, and would specifically utilize the above-described assumed names to compete within the same geographic region for a finite base of customers within the competitive electric market. Due to the overriding similarities in the names described above, and the ability it has to mislead and confuse customers, the Applicant's request to use the assumed name 'Tex-Power' should be denied," StarTex said
