NY Denies Rehearing Of Low-Income ESCO Service Moratorium, Sets Process For Consideration Of Duration, Lifting
The New York PSC denied rehearing requests of its July order prohibiting ESCO service to Assistance Program Participant (APP) customers (see details here), and also established a process for considering the duration of the moratorium, and conditions for lifting the moratorium
Specifically, the PSC will file an emergency SAPA notice concerning the moratorium, and the moratorium will continue for a period of 90 days from the day it is filed with the Secretary of State
During the comment period, parties may address the duration of the moratorium, and conditions for lifting the moratorium.
The PSC will then consider whether to adopt the moratorium for an extended period, or to lift or otherwise alter the moratorium
A written order has not yet been issued
