Illinois WON'T Require Retail Suppliers To Post Offers On PlugIn Illinois, Under First Notice Order (Erroneous Reports Say Otherwise)

There are several reports that the Illinois Commerce Commission, under its first notice order concerning retail electric supplier marketing rules, is proposing to require that retail electric suppliers post their residential offers on the ICC’s PlugInIllinois.org website

This is not the case.

While Staff had proposed such a requirement, the first notice order would decline to adopt it.

"Staff’s proposed subsection (h) requires RESs to post at least one, but no more than three, offers to the Commission’s PlugInIllinois.org website. It is not entirely clear to the Commission why RESs should be required to post offers on the website. It may be free advertising, but if a RES does not want to participate, Staff has not provided a reason or basis for this requirement. The Commission agrees that a list of RESs with contact information is important in case a customer is looking for information, but mandatory posting of offers is not supported," the first notice order unequivocally states

"Also, it is not clear that a RES’s ability to list offers should be limited," the first notice order adds

Currently, about two-thirds of the suppliers with residential customers post their offers on PlugInIllinois.org, the ICC noted

Adoption of a first notice order means the ICC will now submit the revisions to 83 Ill. Adm. Code 412 and 83 Ill. Adm. Code 453 to the Secretary of State to begin the first notice period required for rulemakings. The ICC will have to vote on the rules again before they are final, and the ICC could revise its thinking and elect to adopt such a PlugIn Illinois posting requirement in its final rule, but the ICC is not proposing this currently and has, in fact, specifically rejected such a recommendation.
