In Nod To New York City, NY PSC To Allow Cities To Phase-In Muni Aggregations

In a rehearing order approved today, the New York PSC, answering a concern raised by the City of New York, clarified that it will allow municipalities to implement opt-out aggregations on a phased basis, such that municipalities are not required to place all customers in the aggregation at the same time

The City of New York had requested that the Commission clarify that a municipality can implement an opt-out aggregation program on a rolling or staggered basis across the municipality through pilots or other targeted enrollment programs

The City of New York had said, "the City may want to target a specific borough or neighborhood for initial CCA deployment, in order to test the mechanics of CCA deployment, focus on specific populations such as residential or commercial customers, build internal capacity to administer such a program, and/or target low- income customers or other groups of interested customers that demonstrate an interest in community choice or renewable energy."

The rehearing order, which has not yet been issued in written form, is to find that allowing municipalities to implement opt-out aggregation programs on a partial or phased basis is consistent with the PSC's intent to provide municipalities with flexibility in meeting their unique characteristics and needs.

Further specifics will be addressed in the PSC's written order
