The Public Utility Commission of Texas would consider the impact on the implementation of customer choice at Entergy Texas in considering Entergy Texas's request for a CCN to build a new 1,000 MW ratebased power plant, under a draft preliminary order and list of issues

The consideration of the impacts on customer choice is a standard issue addressed in generation CCN applications at the non-ERCOT utilities

Specifically, the draft preliminary order would include as an issue in the case the following: "What effect, if any, would approval of the proposed Montgomery County power station have on the implementation of customer choice in ETI's service territory, especially the effect on mitigating market power, auctioning rights to generation capacity, potential stranded costs, and divesting generation capacity? PURA § 39.452."
