LaFleur: FERC Working To Issue Orders While Quorum Still Present

FERC, "is working to get as many orders out as we can in the time we have left with a quorum," Acting FERC Chairman Cheryl LaFleur said in a statement

The resignation of Norman Bay, effective as of February 3, 2017, will leave FERC without a quorum

"We are evaluating how best to do the business of the Commission after Commissioner Bay’s departure. We have already confirmed that all existing staff delegations will continue," as LaFleur said that further details will be issued Monday, and "I expect there will be still more to communicate on this in coming days."

"That said, nominations for the three openings at the Commission would be very welcome, and I look forward to the day when we have a full, five-member Commission again," LaFleur said

FERC also issued a statement regarding the Regulatory Freeze memorandum issued by the White House.

"The White House issued a Regulatory Freeze memo on January 20, 2017. The memo is similar to those that were issued in past transitions of Administration, including the 2009 transition to the President Barack Obama Administration. FERC has reviewed the memo carefully. To the extent that the memo applies to the Commission, a triggering event described in the memo is the presence of an official designated by the new President. That happened this week with the designation of Cheryl A. LaFleur as Acting Chairman, much as in 2009 when Jon Wellinghoff was named Acting Chairman. Acting Chairman LaFleur has completed a review of new or pending regulations described in the memo. FERC now will send to the Federal Register previously voted Commission items that need to be published there. Previously set comment deadlines will remain unchanged," FERC said
