PECO Updates Timeline To Allow CAP Customer Shopping If PUC Does Not Rule On Compliance Plan By Mid-March

PECO has filed with the Pennsylvania PUC an update explaining that if the PUC does not rule on a pending Customer Assistance Program (CAP) shopping compliance plan by mid-March, PECO will not be able to implement CAP shopping in April as originally projected.

On September 1, 2016, PECO filed a proposed rule revision to implement shopping in PECO's Customer Assistance Program, per a May 11, 2016 Secretarial Letter.

The proposed rule revision indicated PECO's intention to implement CAP Shopping on April 14, 2017, consistent with the Secretarial Letter (see story here).

Per a court order, retail suppliers will not be permitted to charge early termination fees to CAP customers.

PECO explained in its filing that the April 2017 date is tied to a PECO IT code implementation date (IT "push" date), which occurs six times per year. To fully deploy CAP Shopping in the April 2017 IT push, PECO needs to begin deployment activities by March 16, 2017, the utility said in its filing

If the Commission has issued its approval of PECO's CAP Shopping rule revision by March 16, 2017, PECO will proceed with deployment for the April 2017 IT push, PECO said in its filing

"If approval has not been received by March 16, the next available IT push date is June 16, 2017. In order to deploy on that date, PECO would need Commission approval of the proposed rule revision by May 18, 2017, to achieve the June implementation date," PECO said in its filing

"Also in the September 1, 2016 filing, PECO agreed to convene a CAP shopping education collaborative with interested stakeholders, the Commission's Office of Competitive Market Oversight, and the Office of Communications to address specific components of the CAP Shopping education plan. The collaborative was originally scheduled to occur in the first quarter of 2017, in preparation for the presumed April 2017 deployment. The collaborative effort will resolve customer protection issues that are important to the various stakeholders who will participate in the collaborative. Absent a final Commission approval of PECO's proposed rule revision , there is no concrete basis for those discussions. PECO has therefore informally proposed, and other stakeholders have agreed, that the parties should defer the collaborative until after the Commission resolves the proposed rule revision. When the collaborative is scheduled, PECO will inform the Commission through an additional letter filed in this docket," PECO said in its filing
