New York Proposes To Enshrine Municipal Aggregation's Ability To Enroll Customers On Opt-Out Basis In UBPs

As part of several revisions to the Uniform Business Practices (see related story today), the New York PSC is proposing to exempt municipal aggregations from provisions related to customer authorization and slamming

While the PSC in April of last year adopted an order allowing opt-out municipal aggregation on a statewide basis, it did so by "suspending" application of certain provisions of the Uniform Business Practices related to customer authorization and switching

Now the PSC would revise the UBPs to reflect its decision concerning opt-out municipal aggregations

Specifically, under the proposed revisions, the UBPs would state, "The process of changing a service provider is comprised of two steps and is applicable whenever a customer enrolls with an ESCO, except when the customer is enrolled in a Community Choice Aggregation (CCA) program, in which case this process does not apply."

Furthermore, the revised UBPs would state, "A change of a customer to another energy provider, without the customer’s authorization, commonly known as slamming, is not permitted, except when the customer is enrolled in a Community Choice Aggregation (CCA) program, in which case this does not apply."
