Start-up Drops Sought Use of Name "Texas Utilities Exchange", Would Now Use "Texas Energy Exchange", "Texas Energy X"

The company formerly known as Texas Utilities Exchange, LLC has changed its legal name and has filed a revised application for an electric aggregator certificate with the Texas PUC.

The company's legal name has been changed to Texas Energy Exchange LLC. The company will market itself solely under the brands "Texas Energy Exchange", "Texas Energy X", and "TEX" (the company listed such names as trade names on its revised application)

Under an agreement with TXU, Texas Energy Exchange will not use the "Texas Utilities" or "Texas Utilities Exchange" names. The revised application does not include such names as legal or trade names.

Texas Utilities Company was the former name of what became TXU Corp. in 1999. In opposing the aggregator's sought use of the name "Texas Utilities Exchange", TXU had previously said that, "Texas Utilities Company, Inc. is still owned by the TXU family of companies today," and provided a Certificate of Fact which, "substantiates that Texas Utilities Company, Inc. is still in existence and registered with the Texas Secretary of State today."

Texas Energy Exchange will change its website address from www.texasutilities.exchange to www.texasenergyx.com

Additionally, under the agreement with TXU, Texas Energy Exchange represents that, in the work experience discussion of its managerial personnel on its website, it will replace references to TXU Energy with the generic phrase, "the largest company offering electricity services in Texas."

As previously reported, Texas Energy Exchange's partners include Maxwell Farmer, Kermit Farmer, and Cynthia Farmer. Maxwell Farmer and Kermit Farmer both previously worked for brokers in the Texas market.

Additionally, Texas Energy Exchange in its application lists market veteran Walt Fenoglio as a senior advisor. Fenoglio served as senior manager at TXU and held various positions at its predecessor companies. Fenoglio has also held positions at Texas Energy Aggregation and Edison Mission Energy
