Exelon Enters Into Voluntary Mitigation Plan With Texas PUC Staff, Setting Offer Parameters For Generation
Staff of the Public Utility Commission of Texas and Exelon Generation Company LLC have entered into a voluntary mitigation plan (VMP) concerning the offering practices that Exelon may use when offering certain of its generation resources into the ERCOT market
The VMP addresses Exelon's offer strategy for its natural gas-fired units, specifically: Colorado Bend Energy Center, Colorado Bend II, ExTex La Porte Generating Station, Tenaska Frontier Station, Handley, Mountain Creek, Wolf Hollow Power and Wolf Hollow II.
Adherence to the VMP provides Exelon with an absolute defense against an allegation pursuant to PURA § 39.157(a) and 16 TAC § 25.503(g)(7) of an abuse of market power through economic withholding, with respect to the specific behaviors addressed by the VMP, as provided in PURA § 15.023(f) and 16 TAC § 25.504(e).
The voluntary mitigation plan has a term of three years unless terminated by either party earlier, or if Exelon's installed capacity in ERCOT drops below 5%
