New York ALJs Further Extend Deadline For Mass Market Review Testimony, Set New Date For Hearing
The presiding ALJs in the New York PSC's evidentiary review of the retail energy mass markets has further extended the procedural schedule, pushing the hearing date until late October.
The ALJs adopted the following revised schedule and due dates:
• August 24, 2017: Direct Testimony and Exhibits
• September 20, 2017: Rebuttal Testimony and Exhibits
• September 29, 2017: Updates to Testimony and Exhibits
• October 16, 2017: Response to Updates
• October 25, 2017: Evidentiary Hearing
The new schedule provides for updates to testimony (and responses), which was not part of the prior schedule
"Given the pending NEMA motion, as well as outstanding responses to non‐party ESCO subpoenas, we are providing for updates to testimony and responses thereto. Such updates will be limited to updating factual data, rather than the supplementation or revision of substantive and/or policy arguments," the ALJs said
The ALJs also noted that parties have raised concerns about the service of large documents on one another by email. "The extension of the schedule will allow the parties time to resolve those issues," the ALJs said
Previously, pre-filed direct testimony was due July 14, 2017, with the hearing scheduled for September 6, 2017
