New York ESCO Seeks Extension Of Deadline To De-Enroll Low-Income Customers Under Service Prohibition

Josco Energy Corporation filed a request with the New York PSC to extend the deadline for de-enrolling assistance program participant (APP) customer accounts identified by the electric and gas distribution utilities pursuant to Ordering Clause 10 of the Public Service Commission's Order Adopting Prohibition on Service to Low Income Customers by Energy Service Companies, issued December 16, 2016

Ordering Clause 10 of the Prohibition Order provides that, "[e]very energy service company eligible to serve customers in New York State shall, within 30 days of receiving the communication from the electric and gas distribution utilities pursuant to Ordering Clause 2 and 6 of this Order, de-enroll any customer accounts identified by the electric and gas distribution utilities, provided that existing contracts will continue until their expiration."

"Over the past week, Josco has received communications from the electric and gas distribution utilities in the service territories for which it conducts business, identifying the thousands of customers that must be de-enrolled pursuant to the Commission's Prohibition Order," Josco Energy Corporation said in its request

"The customer de-enrollment process articulated in Ordering Clause 10 is a manual, labor-intensive process, that requires Josco to review the terms of each contract for the customers identified by the utility and draft corresponding notices tailored to the terms of each customer contract. The Company does not have access to an automated software program wherein the work can be performed electronically. Josco has begun the de-enrollment process and is simultaneously sending out notices to customers on a rolling basis as they are identified. However, given the volume of customer contracts that must be reviewed, additional time to complete the process to ensure that the Company is in full compliance and performs the de-enrollment process as accurately as possible is necessary," Josco Energy Corporation said in its request

"For these reasons, and in order to promote the fair, orderly and efficient implementation of the requirements set forth in the Prohibition Order, Josco is requesting a 30-day extension of the de-enrollment deadline provided in Ordering Clause 10," Josco Energy Corporation said in its request
