New York Mass Market Evidentiary Hearings Pushed Back Again
The presiding ALJs in the New York PSC's evidentiary proceeding reviewing the retail energy mass markets have further pushed back the dates for the hearings in the case, as a result of granting parties more time to file rebuttal testimony
Under the new schedule, the evidentiary hearing is now set to commence on November 29, 2017, versus the prior November 1, 2017 start date
Rebuttal testimony is now due October 27, 2017, instead of October 12, 2017
"The above schedule provides parties with 15 additional days to prepare rebuttal testimony. In addition, it provides the parties additional time, beyond that provided for in the existing schedule, to prepare for the evidentiary hearing following the submission of rebuttal testimony. The existing schedule provided parties 20 days to prepare for the evidentiary hearing. With this modification, parties will have over one month to prepare," the ALJs said
The ALJs granted the extension, "given the delay in all parties’ timely receiving the testimony and exhibits they were entitled to receive."
Parties had been engaged in disputes concerning access to redacted portions of initial testimony, and some parties had to issue discovery requests to obtain such material, which hindered their ability to immediately start working on rebuttal testimony.
