New York PSC Issues Show Cause Order To ESCO

The New York PSC issued a show cause order to Got Gas? LLC for the company's alleged failure to timely file its 2017 triennial compliance filing

"The Commission hereby orders Got Gas to show cause, based upon the allegations and findings described herein, why its eligibility to provide services as an ESCO in New York should not be revoked. Got Gas should further show why other consequences, primarily the prohibition to enlist any customers, should not be imposed," the PSC ordered

In its order, the PSC alleged that, "The Department of Public Service (Department or Staff) issued a Notice of Apparent Failure (NOAF) to Got Gas? LLC (Got Gas) on August 8, 2017 for its failure to file Got Gas’ 2017 triennial compliance filing with the Secretary."

In its order, the PSC alleged that, "The deadline for Got Gas’ response was September 7, 2017. Got Gas failed to respond to the Department’s August 8, 2017 NOAF. On October 27, 2017, Staff received a phone call from Got Gas requesting an extension to file the triennial application. Staff granted an extension to November 3, 2017. Got Gas failed to file the triennial application by November 3, 2017."

UBP Section 2.D.2 states that for an energy services company (ESCO) to maintain its eligibility status, every three years the ESCO must re-file, "all information it submitted in its original application package."

Got Gas? LLC was ordered to responded to the show cause order within 30 days
