Texas PUC Adopts Schedule For Distribution Utilities To File Rate Cases (Charges Applicable To REPs)

The Public Utility Commission of Texas adopted a final order, implementing recent legislation, which establishes an ongoing requirement for investor-owned utilities within ERCOT to file a rate case within 48 months of their last rate case decision or settlement

For the initial rate cases under this new deadline process, the utilities will be required to file such rate case by the later of: 48 months of their last decision, or the following dates:

• Texas-New Mexico Power Company: August 31, 2018

• AEP Texas Inc.: May 1, 2019

• CenterPoint Energy Houston Electric, LLC: July 1, 2019

• Oncor Electric Delivery Company LLC: October 1, 2021

Given that some TDUs have recently gone over five years (and closer to 10) without filing base rate cases, the new deadlines will result in more frequent changes to underlying REP pricing based on TDU base rates (various TDU riders do change more frequently)
