Texas Generator To Pay $10,000 Under Settlement With PUC Staff

Mozart Wind LLC would pay $10,000 under a settlement with Staff of the Public Utility Commission of Texas to resolve Mozart's alleged violations of Electric Reliability Council of Texas (ERCOT) Nodal Protocols § 3.21, relating to declarations of summer and winter weather preparedness, and 16 Tex. Admin. Code (TAC) § 25.503(f)(2), relating to requirements of market participants

ERCOT Nodal Protocols § 3.21(4) states that, "No earlier than May 1 and no later than June 1 of each year, each Resource Entity shall submit the declaration in Section 22, Attachment K, to ERCOT stating that, at the time of submission, each Generation Resource under the Resource Entity's control has completed or will complete all weather preparations required by the weatherization plan for equipment critical to the reliable operation of the Generation Resource during the summer time period (June through September)..."

In an April 13, 2018 notice, Commission Staff alleged that Mozart violated PURA § 39.151 by failing to submit the 2017 weatherization declaration by June 1, 2017.

According to the settlement, Mozart submitted its 2017 declaration of summer weather preparedness to ERCOT on July 19, 2017, 48 days beyond the due date.

According to the settlement, on May 17, 2017 Mozart sent its 2017 declaration of summer weather preparedness to Mozart's Qualified Scheduling Entity (QSE), but not to ERCOT.
