New York ESCO Asks PSC To Address Petition To Reinstate Eligibility To Market To Residential Customers

Astral Energy, LLC has requested its eligibility to market to and enroll residential customers in New York be included on the agenda for the New York PSC's next monthly meeting, scheduled to be held on July 12, 2018.

Astral submitted a Petition on February 6, 2018 requesting reinstatement of its eligibility to enroll and market to residential customers.

"It has now been three years since Astral’s eligibility to enroll any residential customers in New York was suspended. Over this time, Astral has made significant changes to its enrollment and marketing practices, in order to ensure Astral’s compliance with the UBP. Astral has worked with outside counsel to restructure its internal compliance program, resolve customer complaints, and remain in compliance with the Commission’s regulations and orders and the UBP. As a result, on December 16, 2016, the Commission issued an order allowing Astral to once again market to and enroll non-residential customers. Since the Commission reinstated Astral’s ability to market to and enroll non-residential customers in December 2016, Astral has received very few inquiries from customers. We are confident that Astral’s new policies and practices will similarly benefit residential consumers," Astral said in its request

"Astral, in accordance with the December 2016 Order, has also continued to implement and follow the Telemarketing Quality Assurance Program and Telemarketing and In-Person Training Manuals contained in its Compliance Policy and Protocols Manual that it filed on April 11, 2016 and updated on November 29, 2016. Additionally, per the December 2016 Order, Astral has continued to report to the Department the detailed results of its investigation of each customer complaint sent to the Company by the Department and has been responsive to all other requests made by the Department. Astral has further incorporated changes required by the recent order further modifying the UBP," Astral said in its request

"Astral regrets deeply the errors that have led to its suspension of marketing and enrolling customers in 2015, and has been cooperative with the Commission in rectifying these mistakes for the past three years. Continued suspension of Astral’s ability to market to and enroll residential customers is a significant burden to the success of Astral as a business. Therefore, Astral requests that the Commission grant its February 6, 2018 Petition to Reinstate Astral’s eligibility to serve residential customers at (or before) the July Commission meeting," Astral said in its request
