Texas Staff Seek Ruling On Voluntary POLR Petition

Staff of the Texas PUC formally sought a ruling on Constellation NewEnergy, Inc.'s late-filed request to serve as a volunteer Provider of Last Resort (POLR, or VREP).
As previously reported, Constellation NewEnergy filed its request one day out of time. Per a preliminary PUC Staff filing, Constellation filed to serve as a volunteer POLR for all classes at Oncor and CenterPoint Energy Houston Electric
Other than Constellation, the only other REP seeking to serve as a voluntary POLR is TXU Energy.
Constellation has sought a good cause exception to the July 31 deadline for VREP submissions
Staff said that it is preparing its final POLR list and said that, "In order to determine whether Constellation should be included on the final list, Staff respectfully requests that the Commission Administrative Law Judge rule on Constellation's motion for a good cause exception to the requirement of 16 TAC § 25.43(1). Commission Staff is unopposed to Constellation's request for a good cause exception, but reserves the right to object if similar behavior becomes a pattern by REPs in future VREP proceedings."
