Regulator Adopts Price To Compare Language To Be Included On Utility Consolidated Bills For Retail Supplier Customers

The Illinois Commerce Commission approved a petition from Ameren Illinois for a declaratory ruling that the listing of Price to Compare information on all utility electric bills for small volume customers, including utility consolidated bills sent to customers of alternative retail electric suppliers, does not violate various rules which generally prohibit advertising, except for legitimate consumer education efforts

With such ruling, Ameren Illinois said that it will place the following bill messages within the bill message section of the customer bills for residential accounts and commercial accounts receiving service at secondary delivery voltage under Rate DS-2 that have the premises attribute of 15,000 kWh or less annual usage (except for those on the Single Bill Option or the summary bill option).

In addressing Ameren's petition, the PUC declined to adopt modifications proposed by ICEA, which had recommended against making a characterization of the PEA that is meant to be short term such as Ameren’s proposed language that it is expected to "remain small for the foreseeable future." Instead, ICEA had recommended the Commission modify that sentence to state in full as follows: "The price does not include the purchased electricity adjustment line item, a value that changes monthly and may be a charge or credit."

A proposed order adopted by the ICC without modification declined to adopt the ICEA language and stated, "further modifications can be made upon filing by any party."

"The parties should continue to use the workshop process to further refine the PTC language, if necessary. The Commission notes that Commonwealth Edison Company made a similar filing late last year in Docket No. 18-1623 and the Commission’s directives about future proceedings on this topic are intended to be consistent. Finally, the ORMD is directed to file a report to the Commission within 180 days and, should the parties suggest changes to the language described above, Ameren should file a petition in a new docket to litigate the matter," the adopted proposed order provides

Ameren previously stated an intent to start including the above bill message on bills starting in March 2019
