ESCO Again Asks New York PSC To Rule On Outstanding ZEC Compliance Reduction Petition

Astral Energy, LLC has again requested that the New York PSC consider and rule on Astral’s April 27, 2018 Petition for Reduction of ZEC Compliance Payments for 2018-2019

As first reported by EnergyChoiceMatters.com, Astral first submitted the petition on April 27, 2018, and on February 4, 2019, asked that the PSC rule on the petition by March 1, 2019

In a March 6, 2019 letter, Astral stated, "It has been over ten months since Astral Energy, LLC ('Astral') submitted a Petition for Reduction of ZEC Compliance Payments for 2018-2019 (the 'Petition') to the New York Public Service Commission ('Commission'). Astral submitted its Petition on April 27, 2018. Its Petition was subsequently published in the State Register, nearly seven weeks later, on June 13, 2018, with public comments due within sixty days of the publication date. No comments were received on Astral’s Petition."

"On February 4, 2019, Astral submitted a letter (the 'February 4 Letter') requesting that the Commission consider and rule on Astral’s April 27, 2018 Petition by March 1, 2019. To date, no ruling has been issued," Astral stated

"DPS Staff has made clear that unless and until the Commission issues an order granting Astral’s Petition, Astral is obligated to pay the ZEC compliance amount that was calculated by NYSERDA under its historic methodology, or risk being the subject of an adverse enforcement action. As previously stated in the February 4 Letter, Astral is vulnerable to adverse action unless and until the Commission issues a ruling on its April 2018 Petition," Astral stated

"Astral respectfully requests a ruling on its April 2018 Petition as soon as possible, but no later than March 22, 2019," Astral stated
