(together, Infinite Energy) sent a cease and desist letter to Infinite Watts, LLC demanding that Infinite Watts, LLC, an entity unaffiliated with Infinite Energy, cease and desist from further promotion and sale of energy resources bearing the "Infinite Watts" mark

Infinite Energy had asserted that, "Infinite Watts' attempt to do business as an REP under a virtually identical tradename would materially impact Infinite Energy and cause confusion amongst customers who have come to recognize and respect the Infinite Energy brand name."
