ESCO Seeks Extension Of Waiver To Continue Serving Assistant Program Participant Customers With Guaranteed Savings Product

Ambit New York, LLC requested from the New York PSC an extension of the waiver of the prohibition on service to low-income customers by energy service companies (ESCOs) so Ambit may continue to offer its guaranteed savings plan product (GSP) to its customers in New York, to which the PSC previously granted a waiver

Ambit said in a filing with the PSC that, "In its Order Approving Ambit New York, LLC’s Petition for Waiver of the Prohibition on Service to Low-Income Customers by Energy Service Companies('Order'), the Commission required Ambit to submit this Petition within 24 months of the Order granting the Waiver. Although Ambit’s Petition is untimely, Ambit submits that this technical deficiency should not impact Ambit’s ability to continue to offer services to low-income customers. As previously indicated, Ambit continues to provide a guaranteed savings program to all its customers in New York which meets the mandates of the Commission’s Prohibition on Service to Low-Income Customers by Energy Service Companies ('Prohibition Order') which prohibited ESCOs from offering services to customers who were participants in utility low-income assistance programs (Assistant Program Participant, or 'APP'), unless a guaranteed savings product was offered to these customers."

"Since September 2017, Ambit has provided quarterly reports to the NYPSC detailing the savings calculations for those customers who have been identified as APP participants. Further, these reports have shown Ambit’s ability to ensure that the customer will not pay more than what they would have paid to the utility by showing the amounts that the customers saved under Ambit’s guaranteed saving program or the amounts that customers were refunded. Ambit submits that during the two years of its participation, the company has continuously met its burden of verifying compliance with the assurances made under the company’s initial request for a waiver," Ambit said

"Ambit’s GSP methodology and calculations have been vetted by the Commission and Ambit’s savings claims have been found to be reliable and sound. Ambit’s guaranteed savings program meets the Commission’s mandate that a guaranteed savings program ensures delivery of the claimed savings, an ability to calculate what the customer would have paid to the utility, a willingness and ability to ensure that the customer will be paying no more than what they would have paid to the utility, and has the appropriate reporting and the ability to verify compliance," Ambit said
