Energy Efficiency-as-a-Service Provider To Place Customers With Retail Supplier

Budderfly, Inc., which describes itself as a provider of Energy Efficiency-as-a-Service solutions, will refer customers to a selected retail energy supplier.

In a filing with the Pennsylvania PUC, Budderfly said that it, "has and will provide energy management services to commercial customers (not residential customers) at various locations across Pennsylvania and has developed an 'Energy Management Outsourcing' model which includes deploying energy efficiency equipment, upgrades and technology, a proprietary energy management hardware and software system along with providing billing and other managed services to manage energy expense and reduce energy expense."

"As part of these energy management outsource services, Applicant takes over its customers’ utility accounts, is the party legally responsible to make payment to the utilities and pays the utilities. Applicant separately invoices its customers on a calendar month basis under contract terms that economically result in Applicant and its customer splitting the savings that result from the energy efficiency measures implemented by Applicant," Budderfly said in its filing

"In order to achieve rate reductions for customers," Budderfly said in the filing that it may, from time-to-time, "enter into agreements with competitive suppliers of electricity for these customer accounts." Budderfly does not take title to the electricity.

"Because these activities are incidental to Applicant’s core business of installing energy efficiency capital upgrades in customer facilities, then monitoring electricity usage and generally managing customers' energy needs, Applicant does not market itself as a broker or aggregator, but rather markets its energy efficiency services," the company said in its filing

"As part of and incidental to these managed energy services, Applicant agrees with customers to seek rate reductions/savings. In order to help achieve rate reductions, Applicant currently intends to place eligible customer accounts within Pennsylvania with Direct Energy for quotes on competitive energy supply, and where the quoted rates represent sufficient savings, Applicant intends to enter into supply agreements with Direct Energy on behalf of customers. Applicant currently intends to deal only with Direct Energy, in order to take advantage of better pricing and commission terms as a result of the volume of business, and to assure that sufficient resources and attention will be available from Direct Energy. However, Applicant is not committed by contract to deal only with Direct Energy and may in the future use the services of a third-party broker to seek multiple quotes for competitive supply or may do the same using Applicant's own staff," Budderfly said in its filing

Initially, Budderfly applied for a Pennsylvania license as a broker/marketer

However, in a supplemental filing, Budderfly stated, "The applicant, Budderfly, Inc. hereby withdraws its Application (Docket Number A-2019-3014523) to become a supplier of electric generation services in the Commonwealth of Pennsylvania. By way of explanation, the undersigned [Budderfly representative] spoke with [PUC Staff member] from the PA PUC on December 4, 2019. In response to Jeremy's inquiry, the undersigned confirmed that the applicant places customer accounts only with one competitive supplier of electric generation services, namely Direct Energy. In light of this fact, [PUC Staff member] indicated that it is the PUC’s position that the license applied for is not required, and that the application should be withdrawn by the applicant. We are therefore withdrawing the application."
