New York PSC Schedules Technical Conference On Compliance With Retail Energy (ESCO) Reset Order

The New York Department of Public Service will hold a technical conference on January 22, 2020, "to discuss questions regarding compliance with the Commission’s Order Adopting Changes to the Retail Access Energy Market and Establishing Further Process, issued December 12, 2019[.]"

As first reported by EnergyChoiceMatters.com, the PSC's ESCO reset order, among other things, limits ESCOs to offering the following products to mass market customers

• A variable rate, commodity-only product that guarantees savings in comparison to relevant utility commodity service

• A fixed rate product that is limited in price to a 12-month trailing average utility supply rate plus a 5% premium

• A renewable electric commodity that is at least 50% greater than the minimum renewable obligation of the LSE, and which meets locational, deliverability and other requirements that will be delineated in the PSC's order

ESCOs will not be permitted to bundle retail energy commodity with non-energy-related products and services, such as gift cards, frequent flier miles, sports team tickets, etc.

As more fully discussed in our prior story, the PSC's reset order also addressed treatment of moving customers onto a compliant product, and necessary customer verification for such a transition

All ESCOs will also be required to submit a new retail access application form for continued eligibility

The DPS said that interested stakeholders are "strongly encouraged" to submit questions about the December 12, 2019 Order by email by January 17, 2020, to an address listed in the December 26 notice issued in Cases 15-M-0127 et al.

The discussion will primarily focus on submitted questions that fall within the scope of the conference.
