Texas Retail Supplier, Previously Subject To Default, Is In Discussions With PUC Staff To Re-enter Market

Retail electric provider Axon Power & Gas, LLC, which has been subject to default under a TDU tariff, said in a status update with the Texas PUC that Axon is in discussions with PUC Staff to address outstanding issues and re-enter the market

As previously reported, Staff has petitioned for the revocation of Axon's REP certificate. During the pendency of the case, Axon sold its customer book (see details here)

In the status update, Axon stated, "Axon has been engaged in discussions with Commission Staff and has presented Staff with two documents for review: a plan to catch up on all payments to the intervenor transmission and distributions utilities; and a plan to address various operational and management issues that would allow Axon to reenter the market. Axon is authorized to represent that Staff has approved Axon's payment plan, subject to the consent of the intervenor transmission and distributions utilities. Axon has already begun discussions with those parties."

Axon further said that, "After a conference with Counsel for Staff, Axon understands that Axon's plan for market reentry is under review. Accordingly, Axon requests that the Procedural Schedule for this proceeding, as adopted by SOAH Order No. 2 on September 24, 2019, continued to be abated and proposes that on or before Wednesday, March 11, 2020 it will file a status report with the Administrative Law Judge or request that a new procedural schedule be adopted. Axon currently has no customers and during the pendency of the abatement period will take no action to enroll any new customers."
