Texas PUC Adds Provision Providing Retail Providers With 45 Days Notice Before Effective Date Of New TNMP Rider

The Texas PUC adopted an order approving a new rate case expense rider, Rider RCE - Rate Case Expense Docket No. 48591, applicable to retail electric providers at Texas-New Mexico Power
Although the amounts of Rider RCE - 48591 were agreed to in a previously reported settlement, a proposed order did not reflect parties' intention that the rider take effect on the first calendar day of the first month occurring a minimum of 45 days from the date of the Commission's issuance of the final order. Rather, the proposed order included an effective date of January 1, 2020.
The Alliance for Retail Markets filed exceptions to this provision of the proposed order, and further stated that, if the order were approved at the PUC's January 16 meeting, then Rider RCE - 48591 should take effect on March 1, 2020, which is the same date as a scheduled TNMP TCRF update.
The PUC approved language from a memo from Chairman DeAnn Walker to revise the proposed order's language concerning the effective date of the new rider, adopting the stipulation's provision and which results in an effective date of March 1, 2020
With such change, the final order states that, "the effective date will
be the first calendar day of the first month occurring a minimum of 45 days
from the date on which the Commission files its order approving the rate-case
expense rider."
