New York DPS Staff Request Extension Of Deadline To File Report On Development Of ESCO Financial Assurance Requirements

Staff of the New York Department of Public Service has requested an extension, until May 29, 2020, to file a report regarding the development of financial assurance requirements for energy service companies (ESCOs) as a condition of eligibility to serve customers
As previously reported, such a report was required under the PSC's retail market reset order. The report is due April 10
In its request, a representative for Staff wrote, "On behalf of Department of Public Service Staff, I respectfully request an extension of the April 10, 2020 deadline to file a report regarding the development of financial assurance requirements for energy service companies (ESCOs) as part of the eligibility criteria for ESCOs operating in New York State pursuant to Ordering Clause 10 of the Commission’s Order Adopting Changes to the Retail Access Energy Market and Establishing Further Process, issued December 12, 2020, in the above referenced proceeding. Staff met with interested stakeholders on Wednesday, February 26, 2020 and received informal comments from several stakeholders throughout the following weeks. Staff continues to work on its proposal for ESCO financial assurance requirements but requires additional time to develop a recommendation that complies with the Commission’s directive. Thus, Staff requests an additional
extension up to and including May 29, 2020 as necessary to prepare its report. Please contact the undersigned should you have any questions."
