Another ESCO Seeks New York Order Authorizing Green Natural Gas Products

American Power & Gas LLC ("American Power") sought a declaratory ruling from the New York PSC recognizing American Power’s renewable and/or green natural gas products, hereinafter referred to as 'Green Gas Products,' as permissible energy-related value-added products under the PSC's Second Reset Order, or, in the alternative, providing American Power a limited waiver to continue selling and providing Green Gas Products to current and prospective customers during the pendency of the Commission’s review of Green Gas Products in connection with Track II of the PSC's retail market review

As previously reported, for natural gas, ESCOs under the reset order are limited to providing mass market customers with a guaranteed savings (versus the utility) plan, or a fixed rate product that is limited in price to a 12-month trailing average utility supply rate plus a 5% premium. The compliance deadline for such product limits has been extended to August 10, 2020
