FERC Dismisses Petition From Group That Had Sought For FERC To Set Net Metering Compensation Under Exclusive Federal Jurisdiction

FERC has dismissed a petition from the New England Ratepayers Association, which had filed a Petition for Declaratory Order at FERC requesting that the Commission: (1) declare that there is exclusive federal jurisdiction over wholesale energy sales from generation sources located on the customer side of the retail meter, and (2) order that the rates for such sales be priced in accordance with the Public Utility Regulatory Policies Act of 1978 (“PURPA”) or the Federal Power Act (“FPA”), as applicable.

FERC Chair Neil Chatterjee said that the petition did not identify a specific controversy that should be addressed in a declaratory order

A written order of the dismissal was not immediately available
