ESCO Seeks Extension Of New York PSC Deadline To File Home Warranty Standard Sales Agreement, After Authorization Recently Granted For Bundled Product

Constellation NewEnergy has sought an extension from the New York PSC of the deadline for it to file standard sales agreements for its bundled home warranty and energy supply product for which the PSC recently granted authorization under which the product need not comply with the otherwise applicable pricing limits or additional renewable content requirements for mass market products

In its request, CNE said, "In accordance with Ordering Clause 7 of the Public Service Commission’s ('Commission') Order
Addressing ESCO Petitions Requesting Authorization to Provide Additional Products and
Services (the 'Order'), issued on January 25, 2021 in the above-referenced proceedings,
Constellation NewEnergy, Inc. and Constellation NewEnergy – Gas Division, LLC (together,
'Constellation') respectfully request an extension of time from the current compliance deadline
set forth in Ordering Clause 2.
Ordering Clause 2 provides that Constellation shall, within 30 days of the issuance of the Order
(i.e., by February 24, 2021), file its standard sales agreements for each authorized home warranty
product bundle."
"Constellation respectfully requests an extension of an additional 30 days, until
March 26, 2021, to provide the Commission with its applicable sales agreements," CNE said
"Constellation is working diligently to prepare its applicable sales agreements in accordance with
the terms Constellation proposed in its petition and consistent with the Uniform Business Practices
and Commission orders. However, coordination across different teams within Constellation is
necessary due to the information to be included in these sales agreements. Given key employees’
pre-planned vacations around the Presidents’ Day holiday and other commitments of the
individuals involved, Constellation requires additional time to finish gathering and reviewing these
sales agreements," CNE said
"Further, the Commission has determined that other ESCOs seeking to offer home warranty
products must file standard sales agreements, but provides no deadline for such filing.
Constellation should not be under a quicker filing deadline requirement simply because it already
filed a petition that the Commission approved," CNE said
"For the foregoing reasons, Constellation respectfully requests a 30-day extension to comply with
Ordering Clause 2 and file its sales agreements," CNE said
