Pursuant to the authority vested in the New York Public Service Commission by Section 4(2) of the Public Service Law, the Commission has certified to Governor Andrew Cuomo that, "additional commissioners are needed for the proper disposition of the business before the Commission."

The PSC requested that the Governor increase the membership of the Commission to seven members by appointing two additional Commissioners.

Among its other increased responsibilities including implementing climate legislation, the PSC cited, as a reason for the need for increased commissioners, increased enforcement actions undertaken by the PSC and related litigation, though only "utilities" were specifically cited

The PSC noted, "the Commission has commenced a greater number of enforcement actions against utilities and, as a result, has a significant number of open, litigated proceedings currently underway."
