Texas Retail Provider Seeks To Be Relieved From Serving As Non-Volunteer POLR

EDF Energy Services, LLC ('EDF') filed at the Texas PUC a request that EDF be removed as a non-volunteer Provider of Last Resort ('POLR') for Small Non-Residential Customers.

"EDF is currently designated as a [non-volunteer] POLR for Small Non-Residential Customers in the Oncor Electric Delivery Company LLC, CenterPoint Energy Houston Electric LLC, and AEP Texas service areas. This designation was based on the information that EDF submitted in this docket on July 8, 2020. In that same filing, EDF indicated that it elected to opt out of eligibility for POLR for the Small Non-Residential customer class status pursuant to 16 TAC § 25.43(h)(2)(H) because REP does not serve load in the Small Non-Residential customer class except for low-usage sites of EDF’s large non-residential customers, or commonly owned or franchised affiliates of the REP’s large non-residential customers," EDF said

"It is likely that the events associated with the winter storm that occurred over the past week will result in mass transitions of customers. In order to mitigate the impacts to these customers and to EDF, EDF respectfully submits that good cause exists to remove EDF as a [non-volunteer] POLR for Small Non-Residential Customers," EDF said

"Although the deadline to file challenges to Staff’s eligibility determination for a Large Service Provider to serve as a [non-volunteer] POLR has passed, the Public Utility Commission of Texas ('Commission') has the authority to grant this request under 16 Tex. Admin. Code § 25.3(b), which allows the Commission to make exceptions to Chapter 25 of its substantive rules for good cause," EDF said
