Texas PUC Won't Consider Approval Of Late-Filed Requests To Serve As Volunteer POLRs (Requests From Three REPs Affected)

The Manager of Licensing and Compliance for the Texas PUC's Customer Protection Division issued a memo concerning requests from retail electric providers to serve as volunteer POLRs (voluntary REPs or VREPs) that were filed after a recent deadline established by the PUC

In allowing REPs to seek to become volunteer POLRs outside the normal timeline, the PUC ordered that REPs already designated as non-volunteer POLRs could request by 3:00 p.m. on Monday, February 22, 2021 to serve as a volunteer POLR

As previously reported, the PUC approved two such requests, approving Reliant and Gexa's requests to serve as volunteer POLRs. The PUC also approved a request from TXU Energy, a previously approved volunteer POLR, to increase the number of customers it was willing to serve as a volunteer POLR

The PUC's Manager of Licensing and Compliance said in a memo that three companies filed VREP requests after the deadline: AP Gas & Electric (TX) LLC; Evolve Retail Energy LLC (Octopus Energy); and Summer Energy LLC

"Because these three requests were not timely filed, they will not be considered to be approved as a VREP for the 2021-2022 POLR term," the PUC's Manager of Licensing and Compliance said in a memo

On an aggregated basis, the approved volunteer POLRs have agreed to provide service to 4,214,000 ESI IDs across all customer classes in all POLR service areas.

The PUC also approved EDF Energy Services, LLC's request to be relieved of its non-volunteer POLR (Large Service Provider or LSP) obligation for the small non-residential customer class, as EDF Energy Services said that it does not serve load in the small non-residential customer class except for low-usage sites of EDF’s large non-residential customers, or commonly owned or franchised affiliates of its large non-residential customers
