Updated: Reported-Out Committee Substitute For Texas House Bill Banning Wholesale Index Plans Published

The text of a committee substitute for Texas HB 16, which as previously reported was reported favorably by the Texas House State Affairs committee, has now been published
The committee substitute does not include substantive changes to the bill
Under the committee substitute, a retail electric provider may not offer a wholesale
indexed product to a residential customer, with "wholesale indexed product" meaning, "a retail
electric product in which the price a customer pays for electricity
includes a direct pass-through of real-time settlement point prices
determined by the independent organization certified under Section
39.151 for the ERCOT power region."
