The Texas PUC will issue an accelerated proposed rulemaking to lower the high system-wide offer cap in ERCOT from the current $9,000 per MWh by January 1, 2022

To generate discussion, the PUC specifically sought comment on setting the HCAP at $4,500 per MWh, though such number was largely included for the purpose of generating stakeholder comment on the appropriate HCAP level, rather than reflecting any preference of Commissioners at this time. Such public comment will inform the number to be used in a formal proposal for publication to be issued on Oct. 7

The intent is to adopt the changes prior to the winter season while broader market design changes continue to be developed. As such, the instant accelerated rulemaking is intended to discretely address the level of HCAP

The PUC is also interested in whether a specific Value of Lost Load should be set by Commission rule and, if so, what should that value be?
