Texas PUC Clarifies Opt-Out Deadline Under Uplift Securitization Program

The Texas PUC ruled that filings made by entities, such as transmission-level voltage customers, to opt-out of the ERCOT uplift securitization program comply with the filing deadline if the opt-outs were filed before or at any time on November 29, 2021
Any opt-out filing made after November 29, 2021 does not comply with the deadline set in the Commission's debt obligation order, the PUC said
Several entities seeking to opt out filed requests on November 29, 2021 but after 3:00 p.m., the PUC's standard filing deadline for various legal pleadings
However, the PUC found in a declaratory order that the opt-out filings did not constitute a legal pleading or other filing to which the standard 3:00 p.m. deadline applies; and, in the absence of any other specific time in rule or order, the PUC ruled that the deadline for opt-out filings was on or before November 29, 2021.
