Retail Supplier Confirms It Did Not Move Forward With Time Of Use Pilot After Selection Via PSC's RFP

Inspire Energy Holdings, LLC formally notified the Maryland PSC that it did not proceed with a time of use pilot that it had proposed and for which it had been selected under an RFP managed by the PSC

Inspire Energy stated in the letter, "Inspire Energy Holdings, LLC ('Inspire') submits this letter to notify the Commission regarding the status of Inspire’s Time-of-Use ('TOU') Pilot Program Proposal submitted in the Public Conference 44 proceeding and to rescind the TOU Proposal."

"During the Commission’s Administrative Meeting on December 15, 2021, the Commission requested that Inspire provide correspondence with an update indicating whether Inspire will be moving forward with the TOU pilot program or if Inspire will rescind the approval that the Commission granted for the TOU pilot program. As explained below, Inspire was unable to move forward with implementation of its Commission-approved TOU pilot program proposal in the Potomac Electric Power Company ('Pepco') service territory as intended. Inspire acknowledges that it should have notified the Commission and stakeholders in early 2020 when it determined that it was not able to move forward with the TOU pilot as proposed and apologizes for that oversight, as well as the delay in following up on this matter since then," Inspire Energy stated in the letter

"On July 12, 2019, Pepco issued the Commission-approved PC44 Rate Design Retail Supplier Load Shaping Pilot RFP Statement of Work ('RFP'). On August 26, 2019, Inspire responded to the RFP, submitting its retail supplier TOU pilot proposal titled 'An Innovative Load Shaping Proposal.' On December 2, 2019, the Commission issued a Letter Order directing Pepco to accept Inspire’s proposal and noting the forthcoming Evaluation Measurement and Verification ('EM&V') plan to be submitted by Inspire by January 31, 2020, pursuant to the RFP requirements. On January 31, 2020, the Commission issued a Letter Order granting Inspire an extension for the EM&V plan submission until February 14, 2020. After discussions with Pepco and its EM&V contractor, the Brattle Group, Inspire submitted its final EM&V plan, dated February 14, 2020," Inspire Energy stated in the letter

"Shortly after the February 2020 submission of Inspire’s EM&V plan, the onset of the COVID-19 pandemic shifted Inspire’s business plans to manage that crisis while continuing to serve Inspire’s retail electricity customers. Managing operations and adapting to the COVID-19 pandemic prevented Inspire from moving forward with development and implementation of the TOU pilot at that time. Further, as discussed during the December 15, 2021, Administrative Meeting, Inspire had a transition in personnel in its regulatory team during early 2020. This transition included the departure of key personnel overseeing for the TOU pilot program proposal development and implementation efforts. Due to an internal oversight, Inspire did not continue with its planned TOU pilot program and failed to notify the Commission and stakeholders," Inspire Energy stated in the letter

"Inspire acknowledges the significant efforts of the Commission, Commission Staff, utility personnel, and all the PC44 stakeholders that worked to develop and implement the retail supplier TOU RFP. Inspire remains committed to continued innovation in the competitive retail energy marketplace, particularly energy innovations that promote the deployment of clean and renewable energy while enabling customers to take charge of their energy usage. Inspire will continue to work to advance clean and renewable energy innovation in Maryland and the other markets that Inspire serves," Inspire Energy stated in the letter

"While the explanation above does not excuse Inspire’s failure to notify the Commission upon determining that it could not move forward with the TOU pilot program in early 2020 or the lack of notice since then, Inspire offers this update to apologize for its oversight and to explain what happened. Accordingly, Inspire respectfully requests that that the Commission accept this letter as rescission of Inspire’s PC44 TOU Pilot Proposal," Inspire Energy stated in the letter
