The Public Utilities Commission of Ohio approved a stipulation among certain parties in Duke Energy Ohio's electric rate case that includes provisions for a supplier consolidated billing collaborative, elimination of the switching fee and other retail supplier tariff changes, and changes to the supplier tariff provisions applicable to brokers

The stipulation's provisions related to the retail market, as described in our prior story, were adopted without modification

As previously reported, under the settlement, Duke Energy Ohio agreed to withdraw its proposal to amend its GoGreen Ohio rider (Rider GP), which is currently a program allowing customers to purchase blocks of RECs at a price set in the tariff.

Duke had previously proposed creating an option under the GoGreen Ohio rider for larger customers to negotiate a price for renewable energy credits (RECs) with the Company.

With regards to other issues, in adopting the stipulation, PUCO rejected certain proposals from the Ohio Consumers' Counsel, which was not a signatory to the settlement

Specifically, PUCO rejected OCC's proposal for shadow billing of SSO costs on shopping customers' bills, and related billing information and changes

"While we may have approved a Stipulation in the past that includes shadow-billing, corresponding bill format changes, and a shadow-billing report, we note that such provisions were not included in the Stipulation at hand, and as already noted repeatedly, we must evaluate the terms of the Stipulation as they appear on its face," PUCO said

"[T]he Commission emphasizes that customers may choose an energy provider for various reasons. Price is only one attribute of any offer available in the competitive market; there may be other features of the offer that are of value to customers," PUCO said

PUCO also denied OCC's proposal to mandate that Duke accept customer list opt-outs online
