Regulator Denies Muni Aggregation's Petition To Receive Lists Of Competitive Retail (Shopping) Customers

On rehearing, the Massachusetts DPU affirmed its prior finding that customer lists provided to municipal aggregations are limited to those customers who are eligible for opt-out aggregation, and therefore the lists shall not include competitive retail customers who are shopping.
The City of Boston had sought reconsideration of this prior finding. The City had sought to require NSTAR Electric to provide the
City with a list of all customers receiving competitive supply
The DPU denied the City's petition for reconsideration on this issue
"The Department will not expand the list of customers that a distribution company is
required to provide to a municipal aggregator for use in its mailings," the DPU said
"The lists provided are
for the mailing of opt-out notices and not intended to be mass marketing lists," the DPU said
The DPU noted that the City is free to inform shopping customers of the aggregation through various media channels, and that aggregations already enjoy preferred placement on the state's electric choice rate board
