Texas ALJ Approves TDU Interim Rate Change On 3 Days' Notice To REPs

A Texas ALJ today approved, effective on and after September 1, 2023, new interim rates applicable to retail electric providers proposed by CenterPoint Energy Houston Electric (CenterPoint Houston) under an update to CenterPoint Houston's Rider Temporary Emergency Electric Energy Facilities (TEEEF)

"[T]he Administrative Law Judge determines that CenterPoint Houston has shown good cause under 16 Texas Administrative Code § 22.125 for the adoption of interim rates necessary to recover a revenue requirement in the amount of $187,875,401, with prioritization of the revenue requirement as stated in CenterPoint Houston’s Application," the ALJ said

"CenterPoint Houston is AUTHORIZED to charge interim rates to the extent provided in this order. The interim rates shall be effective on and after September 1, 2023," the ALJ said

"CenterPoint Houston SHALL make an appropriate compliance tariff filing reflective of the rates permitted by this order with the Commission’s docket clerk prior to implementation," the ALJ said

As previously reported, REPs opposed a September 1 implementation date for TEEEF interim rates, given the short lead time between the approval date of the rates (Aug. 28) and the Sept. 1 date on which the rates take effect and by which the rates are required to be reflected in various REP marketing and compliance documents (EFLs, etc)
