Update: Court Approves Transfer Of Customers To Providers Of Last Resort

A federal bankruptcy court has approved the transfer of Astral Energy, LLC's customers to the applicable providers of last resort

The Court ordered that Astral's Trustee is authorized and directed to take such actions as necessary to transfer the customer and customer accounts of the Debtor (Astral) to the applicable provider of last resort, to be effected as soon as possible.

As previously reported, the New York ISO had already dropped Astral's customers to default service, but in PJM and potentially other markets, Astral energy customers had remained with Astral notwithstanding the filing of a Chapter 7 bankruptcy petition by Astral (more background here)

In a filing with the PUC of Ohio, AEP Ohio represented that, "Based on AEP Ohio’s understanding of the bankruptcy filing, Astral is no longer in business and unable to transmit standard EDI transactions, specifically drop transactions to return customers to AEP SSO."

In a filing to the PUC of Ohio, AEP Ohio further represented that, "In addition, Astral contracted with a third party for supply of energy to PJM and credit support, Boston Energy Trading & Marketing, LLC (BETM). BETM is extremely anxious to have all customers returned to the utilities’ respective POLR/SSO service."

In a filing to the PUC of Ohio, AEP Ohio represented that, "A Trustee was appointed in the bankruptcy case to operate Astral’s business, but has no ability to generate EDI transactions. The Trustee has been authorized through a bankruptcy court order on October 11, 2023 to transition affected customers to POLR/SSO service. Therefore, consistent with Ohio Revised Code ('R.C.') 4928.14 and Section 31.23.a.9 of the Terms and Conditions of AEP Ohio’s OAD tariff (OAD Section 31.23.a.9, AEP Ohio will create EDI drop transactions for the impacted customers to be returned orderly to the Standard Service Offer on the customers’ scheduled on-cycle meter read dates after commission approval. Currently AEP Ohio serves 10 customers under Astral."

AEP Ohio said that, "Currently AEP Ohio serves 10 customers under Astral."
