Texas PUC Designates ERCOT Winter Capacity RFP As Interim Solution Subject To PURA Cost Cap

In a vote today, the Texas PUC has designated ERCOT's winter capacity RFP as an interim solution under PURA § 39.1594(a)(1).

This means that costs under the winter capacity RFP will be included in the total capped cost of any performance credit mechanism

As previously reported, ERCOT developed a confidential budget for the winter capacity RFP, but did not file it publicly, expressing concerns that bidders could exploit the information to bid right at the cap

Texas PUC Commissioner Will McAdams also said that the PUC will need to allow retail electric providers to pass-through costs under the winter RFP to customers on fixed rate contracts

The retail market cannot absorb that type of unexpected cost on short notice, McAdams said of the winter capacity RFP costs
