PUC Revokes License Of Retail Supplier

The Pennsylvania PUC revoked the electric generation supplier license of Sunwave Gas & Power Pennsylvania Inc. (the Company or Sunwave), as the PUC said that, "The Company has not complied with multiple statutory, regulatory, and Commission Ordered directives."

As previously reported, Sunwave returned Pennsylvania customers to default service in the summer of 2022, and generally ceased operations

The PUC previously in 2023 issued a decision (which became final after it was not contested) that concluded that Sunwave Gas and Power Pennsylvania Inc. violated certain of the state's retail market regulations and rules when Sunwave prematurely ended the fixed rate contract of a customer by dropping the customer to default service (see details here)

In a November 9 EGS license revocation order, the PUC said, "the Company has not provided proof that it notified customers that it intended to transfer them to default service, in violation of Commission regulations relating to abandonment of an EGS license."

The PUC said, "while the Company does not owe any annual or supplemental fees to the Commission, it does have outstanding tax obligations to the Pennsylvania Department of Revenue, a violation of Sections 501(c) and 2809(c) of the Code, 66 Pa.C.S. §§ 501(c), 2809(c)[.]"

The PUC said, "the Company has an outstanding $6,000 civil penalty, which represents a violation of a Commission Ordered directive and a violation of Section 501(c) of the Code, 66 Pa.C.S. § 501(c)[.]"

"The Commission ... hereby revokes the Company’s EGS license pursuant to its authority under the Code and Commission regulations due to Sunwave Gas & Power’s failure to: (1) adhere to the standards of conduct outlined in the Commission’s regulations; (2) satisfy its tax obligations; (3) pay the civil penalty imposed by the Commission; (4) satisfy its AEPS Act obligations; and (5) maintain bond coverage," the PUC said

In revoking the EGS license, the PUC denied Sunwave's application to voluntarily abandon its EGS license
