New York PSC Formally Revokes ESCO's Eligibility

The New York PSC formally revoked Astral Energy LLC’s eligibility to serve energy customers as an ESCO in New York State.

The PSC said, "On November 27, 2023, the Commission issued an Order Instituting Proceeding and to Show Cause (OTSC) against Astral Energy LLC (Astral Energy, or the Company) for failure to purchase zero-emission credits (ZECs) and renewable energy certificates (RECs) from the New York State Energy Research and Development Authority (NYSERDA) in accordance with the Order Adopting Clean Energy Standard, the Order Approving Zero-Emissions Credit Implementation Plan with Modifications, and the Order Adopting Modifications to the Clean Energy Standard. The Commission ordered Astral Energy to show cause within 15 days why its eligibility should not be revoked, or, in the alternative, have other consequences imposed upon it, as described in the Commission’s rules governing ESCO eligibility in the Uniform Business Practices (UBP) Section 2.D.6. Astral Energy did not substantively respond to or contest the allegations in the Commission’s November 2023 Show Cause Order and has therefore defaulted. By this Order, the Commission revokes Astral Energy’s eligibility to serve energy customers in New York State."

As previously reported, Astral last year declared bankruptcy under Chapter 7, and its customers were previously transferred to default service
