Axon Power & Gas Now Working On Terms To Voluntarily Relinquish REP Certificate

Axon Power & Gas, LLC said in a status report with the Public Utility Commission of Texas that it is now working with PUC Staff to develop terms and conditions under which Axon will voluntarily relinquish its authority to operate as a retail electric provider in Texas and leave the market.

As previously reported, ERCOT recently revoked Axon Power and Gas LLC's rights as a Market Participant and terminated Axon's SFA [Standard Form Market Participant Agreement] with ERCOT. (see details here)

Axon had previously been subject to default under a TDU tariff in 2019, and had sold its customers to another REP last year (see details here). A petition from PUC Staff to revoke Axon's certificate due to the 2019 TDU default is currently abated, and, prior to recent events, Axon had been in discussions with PUC Staff to address outstanding issues and re-enter the market

However, in a September 11 status update to the PUC, Axon stated, "At the time of the last Status Report, Axon reported certain events required that a proposed resolution of this proceeding be significantly and substantially altered. As a result of those events, Axon is now working with Staff to develop terms and conditions under which Axon will voluntarily relinquish its authority to operate as a retail electric provider in Texas and leave the market."

"Axon requests that the Procedural Schedule for this proceeding continue to be abated and proposes that on or before Friday, October 16, 2020 it will file a status report with the Administrative Law Judge or request that a new procedural schedule be adopted. Consistent with SOAH Order No. 4, Axon will provide the ALJ a proposed procedural schedule in Word format when the Parties are ready to resume this docket. As in its prior motions, Axon further represents that it currently has no customers and will take no action to enroll any new customers while the proceeding is abated," Axon stated
