Utility Proposes To Cease Providing Customer Lists To Retail Suppliers

As part of implementing a statutorily required "Do Not Transfer List", Baltimore Gas & Electric is seeking to cease the provision of customer lists to retail energy suppliers
The Do Not Transfer List, required under SB1, reflects customers who indicate to the utility the customer's desire to remain on SOS indefinitely and the customer's desire to not receive directed marketing from retail suppliers
BGE said that, in light of the newly required Do Not Transfer List, the existing customer lists made available to retail suppliers, "will no longer be appropriate."
BGE currently makes residential customer lists available for purchase by retail suppliers for a cost of $715 per list. Customers may opt-out of inclusion on the customer list
BGE reported that, since 2021, retail suppliers have only purchased 8 customer lists, with the most recent purchase being in October 2022
BGE said that costs to modify the existing customer list process and systems to avoid conflicts with the new Do Not Transfer List would likely go un-recovered given the few purchases of the customer lists by suppliers. BGE also raised the potential for customer confusion in maintaining both lists
Subject to approval of changes in its supplier coordination tariffs, BGE plans to stop offering the existing customer lists
BGE anticipates having the Do Not Transfer List available no later than January
2025, barring any complications
In contrast, Potomac Edison indicates that it will continue to offer to retail suppliers an "Interested Customer List", which is a list of all residential customers excluding customers who opt out of inclusion in the Interested Customer List (generally, despite its unique name, the Interested Customer List is a customer list or eligible customer list)
Potomac Edison said that retail suppliers will be responsible for "appropriate use" of both the new Do Not Transfer List and existing Interested Customer List.
In its filing, Potomac Edison did not explicitly state that it will itself remove, from the Interested Customer List, customers who sign up for the Do Not Transfer List, and PE's filing also does not suggest that Potomac Edison will remove Do Not Transfer List customers from the Interested Customer List
Washington Gas Light's compliance plan for implementing a Do Not Transfer List also suggests that "marketing lists" will continue to be provided to retail suppliers. While WGL is still evaluating options for implementation, WGL's filing suggests that WGL initially intends to have Do Not Transfer List customers removed from the marketing lists provided to retail suppliers.
