No Immediate Ruling After Hearing On New York Energy Broker Regulation Preliminary Injunction

A New York Supreme Court judge heard today oral arguments from ESCO parties and the New York PSC concerning a preliminary injunction sought by ESCO parties against the PSC's broker regulation order
A ruling on the preliminary injunction was not issued from the bench at the conclusion of the hearing today
The judge indicated to parties that the court would issue a decision on the matter as soon as it can.
As of publication time, no order from the court concerning the request for a preliminary injunction was publicly available
The preliminary injunction, if granted, would essentially extend a temporary restraining order, previously granted against enforcement of the PSC's broker regulation order, until such time as the substance of the appeals are resolved by the court

-- Index 907356-24, brought by Citizens Choice Energy, LLC and Diversegy, LLC
-- Index No. 907244-24, brought by the New York Retail Choice Coalition (NYRCC) and M&R Energy Resources Corp.
Both cases are captioned as filed under the Supreme Court for the County of Albany, New York, but, as is customary for such Article 78 appeals, a judge from another county may hear the case (as was the case for today's oral argument)
